Going to trial doesn\u2019t happen as often as you might think. Most disputes are resolved by settlement or in mediation.<\/p>\n
Mediation\u2014or Alternative Dispute Resolution (ADR)\u2014is the voluntary collaboration and cooperation of both parties to work toward a resolution. Unlike litigation, mediation gives you more control over the outcome of your dispute. There is no judge or jury that will decide your fate\u2014no “winner take all.”<\/p>\n
Instead, you’ll negotiate and come to terms that you agree to. There are more options on the table. Decisions are made in a private, non-confrontational setting. This usually saves you time and money, and it minimizes confrontation and potential public-relations risks. In mediation the parties craft the terms of their resolution.<\/p>\n
